1.1 Informational Tool: BetMind is a Software-as-a-Service (SaaS) platform providing automated, data-driven statistical model predictions ("Predictions").
1.2 No Advice: Predictions and all platform outputs are NOT betting advice, financial advice, or professional recommendations. They are mathematical probabilities.
1.3 Automated Methodology: Predictions are generated by automated algorithms. While certain features (such as line movement alerts on logged bets and streak notifications) reference your activity within the platform to surface relevant data, these references are informational and do not constitute personalized gambling advice.
1.4 Kelly Criterion Disclaimer: BetMind may display Kelly Criterion bankroll sizing calculations. These are mathematical outputs based on user-provided bankroll inputs and model-estimated probabilities. They are NOT financial advice. You are solely responsible for any wager amounts you choose to place.
1.5 Performance Tracking: Historical model performance, including "Against the Spread" (ATS) records displayed on the platform, is provided for informational purposes only and does not guarantee future results.
2. Eligibility & Responsible Gaming
2.1 Age & Jurisdiction: You must be at least 21 years of age to create an account. You are responsible for ensuring your use of this data complies with local laws.

3. Data Sources & Third-Party Dependencies
3.1 Data Providers: BetMind utilizes data from third-party sports data APIs. We do not guarantee the accuracy or timeliness of this data.
3.2 AI Dependency (Anthropic): AI-generated analysis is produced by a third-party large language model (Anthropic Claude). BetMind does not control the outputs of this model and is not liable for inaccurate or inconsistent AI-generated content.
3.3 Live Analysis: Live game analysis reflects data at the time of generation and may become inaccurate within seconds due to in-game events. BetMind is not liable for decisions made based on live analysis.
3.4 Anti-Scraping: Automated extraction of data (scraping) is strictly prohibited.
4. Subscriptions, Billing, and Cancellations
4.1 Tiers: BetMind offers three tiers: Free ($0), Pro ($14.99/mo), and Sharp ($29.99/mo).
4.2 Payment Processing: All payments are processed securely via Stripe.
4.3 Cancellation: Subscriptions may be cancelled at any time through your Account Settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued. All sales are final. Refunds are issued solely at BetMind's discretion.
4.4 Referral Credits: Referral credits are non-transferable, have no cash value, and expire upon account termination.
5. Account Management & Data
5.1 Termination: BetMind reserves the right to suspend or terminate accounts for violation of these Terms, fraudulent activity, or unauthorized use, with or without notice.
5.2 Data Retention: User data, including bet history and analyses, is retained for the duration of your account. Upon account deletion, data is purged within 30 days except where retention is required by law.
5.3 Discord Community: BetMind's Discord is a third-party platform governed by Discord's Terms of Service. User-generated content therein is not BetMind's responsibility.
6. Limitation of Liability
6.1 The Cap: To the maximum extent permitted by New York law, BetMind's total liability for any claim shall not exceed the total amount you paid to BetMind in the three (3) months prior to the claim.
6.2 No Warranty: The service is provided "as-is." BetMind is not liable for financial losses or "stale" data resulting from API outages or Sentry-logged system errors.
7. Dispute Resolution
7.1 Arbitration: Any dispute will be settled through binding individual arbitration in New York, NY.
7.2 Class Action Waiver: You waive any right to participate in a class-action lawsuit.
